Coverage, eligibility requirements, and exclusions

• Unless the customer chose a local pickup option, sellers must deliver the item to the address shown in the Order details.
• If the item does not arrive at the location specified by the customer at the time of purchase or is not made available for collection, the buyer is entitled to a full refund, including original shipping charges (if applicable).

When the buyer doesn't receive an item

• Sellers must deliver the item accurately as indicated in the listing.
• If the customer obtains the incorrect item, or the item is broken, damaged, or malfunctioning (and was not clearly represented as such), they are entitled to a refund, even if the vendor does not accept returns.
• Buyers and sellers may reach an alternative agreement, such as a full or partial refund while the buyer keeps the item, or a replacement item in lieu of a refund.
• All relevant return regulations must be met by both buyers and sellers.
• The seller is responsible for return postage if an item is returned.

When the seller does not fulfill their return policy

If the listing specifies that the seller accepts returns, the customer may return the item for any reason, including changing their mind about the item ("remorse" returns).

When a buyer requests a return under the vendor's return policy, the seller must enable them to return the item for a full refund.

The vendor may deduct the original delivery expenses from the refund.

When the seller does not provide returns or a regretful return request falls beyond the seller's return deadline, the seller has the authority to accept or refuse the return.

Though the seller accepts the return, it will be considered as if they had offered returns in the listing.{" "}

All relevant return regulations must be met by both buyers and sellers.

If an item is being returned due to buyer's remorse, the listing specifies who is liable for return shipping.

Privacy of Others; Marketing

If Smileszy gives you information on another user, you agree to use the information exclusively for the purposes for which it was given to you.

You may not reveal or transmit a user's information to a third party for non-related activities.

Furthermore, in line with relevant legislation, you may only send marketing messages to users who have accepted to receive them, and only through Smileszy Services.

If you (as seller) choose to reimburse a buyer or Smileszy under the Smileszy Money Back Guarantee, you authorise Smileszy or Smileszy payments entities to deduct the amount of the reimbursement from your current or future sales proceeds, linked financial account, or other payment method on file, as described in the Payments Terms of Use - opens in a new window or tab.{" "}

If you receive your transaction proceeds via PayPal, you enable Smileszy to deduct the reimbursement amount from your PayPal account (in the same or other currency).

If we are unable to get reimbursement from you, we may use alternative collection procedures, including as employing collection agencies, to collect the remaining amounts.

If we detect misuse or interference with the normal operation of the policy, we may stop the Smileszy Money Back Guarantee in whole or in part without notice.
